General Terms and Conditions of Sale (GTCS)

PREAMBLE

These General Terms and Conditions of Sale (hereinafter "GTCS") apply exclusively between:
On the one hand, the company G.T.A.F. (trading under the name 321CBD), a Simplified Joint Stock Company (SAS) with a capital of €1,000, registered with the Strasbourg Trade and Companies Register under number 852 930 924, whose registered office is located at 4 rue Ettore Bugatti, 67201 Eckbolsheim, France (Intracommunity VAT No.: FR05852930924), editor of the website www.321cbd.com.
And on the other hand, any natural or legal person purchasing via the website www.321cbd.com (hereinafter "The Customer").

The Customer declares to be of legal age (over 18 years old) and to have full legal capacity to commit to these general terms and conditions. The sale of CBD products is strictly forbidden to minors.

ARTICLE 1: OBJECT

The purpose of these GTCS is to define the contractual relationship between the Seller and the Customer, as well as the conditions applicable to any purchase made through the merchant website 321cbd.com. The acquisition of a product through this site implies unreserved acceptance by the Customer of these conditions of sale.

ARTICLE 2: PRODUCTS AND CONFORMITY

2.1 Description

The products offered for sale are those appearing on the 321cbd.com website on the day of consultation by the Customer. Each product is accompanied by a description provided by the Seller. The photographs are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly regarding natural products (flowers, resins) which are subject to visual variations depending on the harvest.

2.2 Legality (CBD)

The products marketed by 321CBD comply with current French and European legislation.

• All our flowers and resins respect a THC level below 0.3%, certified by independent laboratory analyses.
• The products are not narcotics.
• They are not medicines and cannot replace medical treatment.

ARTICLE 3: PRICE

The prices appearing on the site are in Euros (€) inclusive of all taxes (VAT included), taking into account the VAT applicable on the day of the order. The Seller reserves the right to modify its prices at any time, provided, however, that the price listed in the catalog on the day of the order will be the only one applicable to the Customer. Delivery costs are charged in addition, unless otherwise indicated (see Article 6).

ARTICLE 4: ORDER

The order process follows these steps:

1. Selection of products and addition to the cart.
2. Validation of the cart contents.
3. Identification on the site (or account creation).
4. Choice of delivery method.
5. Choice of payment method and acceptance of the GTCS.
6. Validation of payment.

Confirmation of the order entails acceptance of these conditions of sale. All data provided and the recorded confirmation will serve as proof of the transaction.

ARTICLE 5: PAYMENT

Payment is due immediately upon ordering. The Customer may pay by:

• Credit/Debit Card (Visa, MasterCard, CB) via our secure payment system.
• Any other payment method proposed during the final validation of the cart.

Payments are secured by a data encryption protocol (SSL/TLS) so that no third party can access the information during transmission over the network.

ARTICLE 6: DELIVERY

6.1 Methods

Products are delivered to the address indicated during the order process. Shipments are mainly handled by DPD. Any order placed and paid for before 12:00 PM (Monday to Friday) is shipped the same day.

6.2 Delays and Rates

The indicated times (24h to 48h for France on average) are average observed times.

• Delivery to a Pickup Point (DPD Pickup) is free in France (no minimum purchase required).
• Home delivery (DPD Predict) is charged €3 (free for purchases over €89).
• Other rates (Europe) are calculated and indicated upon validation of the cart.

6.3 Delays and Damage

The Seller cannot be held responsible for consequences due to a shipping delay not of its making. In the event of a damaged package upon receipt, the Customer must make reservations with the carrier or refuse the package, and inform the Seller within 48 hours.

ARTICLE 7: RIGHT OF WITHDRAWAL

In accordance with Article L121-21 of the Consumer Code, the Customer has a period of 14 working days from the receipt of their order to exercise their right of withdrawal.

⚠️ Exception for sealed products (Hygiene)

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
Consequently: No return of flowers, resins, oils, e-liquids, or food products that have been opened or whose seal is broken will be accepted.

Return procedure:

1. Contact customer service via the contact form on the website.
2. Return the products in their original condition (unopened).
3. Return costs are borne by the Customer (except in case of error on our part or defective product upon arrival).

ARTICLE 8: WARRANTIES

All products supplied benefit from the legal guarantee of conformity provided for by Articles L. 217-4 et seq. of the Consumer Code and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

ARTICLE 9: LIABILITY

The Seller is only bound by an obligation of means regarding distance selling. Its liability cannot be engaged for damage resulting from the use of the Internet network.

Health Warning: 321CBD cannot be held responsible for the misuse of products. CBD products must not be smoked (for oils/cosmetics), ingested without precaution, or used by pregnant or breastfeeding women. In case of doubt, consult a healthcare professional.

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of the 321cbd.com website are and remain the intellectual and exclusive property of the Seller. Any partial or total reproduction is strictly prohibited.

ARTICLE 11: PERSONAL DATA

The Seller undertakes to preserve the confidentiality of the information provided by the buyer in accordance with the GDPR. The Customer has a right of access, modification, and deletion of information concerning them.

ARTICLE 12: DISPUTE RESOLUTION

These conditions are subject to French law. In the event of a dispute, the Customer will first contact the Seller for an amicable solution (contact@321cbd.com). Failing this, the French courts shall have sole jurisdiction (Courts of Strasbourg in the event of a dispute between professionals).
