Are THC candies legal in France?

Because they produce a psychotropic effect that impairs cognitive abilities, THC candies are obviously illegal in France and the rest of the EU. But there is a legal alternative that is not lacking in virtues. We tell you all about it!

What is THC candy?

THC candy is a treat that contains tetrahydrocannabinol (THC), the main psychoactive compound in the cannabis plant. They take the form of traditional treats, like gummies, jujubes or lozenges, but they are infused with THC.

Mainly used for recreational purposes, they are starting to appear in certain Anglo-Saxon hospital centers which integrate cannabis therapies, in particular to relieve chronic pain which resists usual analgesic treatment, to fight against anxiety or even neutralize sleep problems, including insomnia and paradoxical sleep disorders.

How is THC candy made?

The process begins by extracting THC from cannabis plants, most often Sativa or Indica varieties, with the use of solvents (such as alcohol or CO2) or by pressure and heat. The goal is to obtain THC in the form of oil or resin.

The THC extract is then mixed with a fatty base, often coconut oil or butter, because THC is fat soluble. The aim here is to create a THC infusion that can be easily mixed with other ingredients.

At the same time, the base of the candy is prepared. It can be sweetened, like a glucose solution, and sometimes gelatinized, depending on the desired consistency.

The THC infusion is then mixed into the candy base. At this point, flavors, colors, and other additives may be added to improve the taste, appearance, and texture of the candy. The mixture is then poured into molds to give it the desired shape (bears, squares, pastilles, etc.). The candies are cooled so that they harden, before being removed from the mold.

Short answer: If we are talking about THC-filled candies that we consume for their psychotropic effects, the answer is negative. This type of product is illegal in France and falls under the law on drug trafficking.

In France, and in other countries of the European Union, only non-psychotropic cannabinoids, which do not induce a “high” or intoxicating effect, are authorized. Concretely, the law only allows the production, marketing and consumption of hemp products displaying a THC concentration of less than 0.3%, i.e. in trace amounts.

As a general rule, THC candies do not fall into this category, since their THC level often exceeds 5%.
